This Privacy Policy explains how Gifted Photo collects, uses, discloses, and retains personal information when you visit giftedphoto.com, upload a photo, create personalized artwork, place an order, or contact us.

Gifted Photo is operated by E-shop sp. z o.o. Our registered business information is available in the Legal Notice. Privacy questions and requests can be sent to contact@giftedphoto.com.

Information we collect

Contact and order information: name, email, phone number, billing and shipping address, order details, payment status, and support messages.
Photos and personalization content: uploaded photos, generated artwork, names, instructions, selected styles, previews, and print files.
Device and usage information: IP address, browser, device identifiers, pages viewed, interactions, cookies, and similar technical data.
Payment information: payments are processed by Shopify and its payment providers. We generally do not receive complete payment card numbers.

How we use information

We use personal information to:

generate previews and personalized artwork;
create, process, print, ship, and support orders;
provide digital products and customer account features;
communicate about orders and respond to support requests;
prevent fraud, abuse, and security incidents;
operate, analyze, and improve the store;
comply with accounting, tax, legal, and regulatory obligations;
send marketing communications where permitted, with an option to unsubscribe.

Uploaded photos and generated artwork

You should upload only content that you own or have permission to use. We use uploaded photos and personalization content to provide the requested generation, preview, order production, delivery, and support services.

We do not sell uploaded photos or personalized artwork as stock content, and we do not use them in public marketing without permission.

How we disclose information

We disclose information only as reasonably necessary to operate the store, including to:

Shopify and payment providers for storefront, checkout, payments, fraud prevention, and store administration;
AI generation, image processing, cloud storage, hosting, email, analytics, and security providers;
production, fulfillment, shipping, and carrier partners that need order and delivery information;
professional advisers, authorities, or other parties when required by law or needed to protect legal rights;
a buyer or successor in connection with a merger, financing, sale, or transfer of the business.

Retention

We retain information only for as long as reasonably necessary for the purposes described above. Temporary uploaded images that are not associated with a purchase are generally scheduled for deletion after approximately 14 days. Artwork and print files associated with completed orders may be retained for up to 90 days to support production, delivery, reprints, and claims.

Order, transaction, tax, fraud-prevention, and customer-support records may be retained longer where required for legal, accounting, security, or dispute-resolution purposes. Deleting an image file does not necessarily delete the related order record.

Cookies and advertising

We and our service providers may use cookies and similar technologies for essential store functions, analytics, security, customer preferences, and advertising where enabled. You can manage non-essential cookies through the store's privacy controls where available or through your browser settings.

We do not sell personal information for money. Some analytics or advertising activity may be treated as a "sale," "sharing," or targeted advertising under certain U.S. state privacy laws. Where required, you may opt out through the available privacy controls or by contacting us.

U.S. state privacy rights

Depending on your state of residence and whether the applicable law applies to our business, you may have the right to request access, correction, deletion, or a copy of personal information, and to opt out of certain sales, sharing, targeted advertising, or profiling. You may also have the right to appeal a denied request and to receive equal service without unlawful discrimination for exercising your rights.

International processing

Gifted Photo and its service providers operate internationally. Personal information may be processed in the United States, the European Union, and other countries where our providers operate. We use contractual and organizational safeguards where required.

Children

The store is intended for adults and is not directed to children under 13. If you upload a photo of a child, you confirm that you are the parent, legal guardian, or otherwise have lawful authority to use the photo for the personalized product.

Security

We use reasonable technical and organizational safeguards designed to protect personal information. No online service can guarantee absolute security.
