These Terms of Service apply to your use of Gifted Photo and purchases made through giftedphoto.com. By using the store or placing an order, you agree to these Terms.

1. Our products

Gifted Photo creates personalized AI-assisted artwork from customer-provided photos and instructions. Products may include digital files, posters, framed posters, canvas prints, and framed canvas prints, as shown on the relevant product page.

2. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to place an order. You are responsible for providing complete and accurate information.

3. Your photos and instructions

You retain the rights you have in content you upload. You confirm that you own the content or have permission to use it and that it does not violate privacy, publicity, intellectual-property, or other rights.

You grant Gifted Photo and its service providers a limited license to process the content only as needed to generate artwork, display previews, produce and deliver your order, provide support, prevent abuse, and comply with legal obligations.

We may refuse content that is unlawful, abusive, deceptive, infringing, sexually exploitative, or otherwise unsuitable for the service.

4. AI-generated artwork and previews

AI-generated artwork is an artistic interpretation and may not reproduce every detail of the original photo. Results may vary between generations. Before ordering, you are responsible for reviewing the preview, spelling, crop, product type, frame, size, and personalization details.

Minor differences between the screen preview and printed product may occur because of screen calibration, print materials, cropping, texture, and production processes.

5. Orders and payment

An order is placed when checkout is completed and payment is authorized or captured. Prices, shipping charges, and applicable taxes are shown at checkout.

We may refuse, cancel, or refund an order if payment fails, fraud or abuse is suspected, content violates these Terms, a product is unavailable, or there is an obvious pricing or technical error.

6. Personalized products and cancellations

Physical products are personalized and made to order. Once production begins, they cannot be cancelled, returned, exchanged, or refunded because of a change of mind, an incorrect customer selection, an incorrect uploaded photo, or approved personalization details.

This does not limit remedies for products that are damaged, defective, incorrect, materially misdescribed, or not delivered. Our Return and Refund Policy provides additional details.

7. Digital products

Digital products are delivered electronically. After a digital item has been delivered or downloaded, it is generally non-refundable except for duplicate charges, unresolved technical failures, or where required by law.

8. Shipping

Production and delivery estimates are provided on the product page or at checkout. Estimates are not guarantees unless expressly stated. If shipment is delayed beyond the promised time, we will provide any notice, cancellation option, or refund required by applicable law. See our Shipping Policy.

9. Personal use

After full payment, you may use the final personalized artwork for personal, non-commercial purposes. Commercial use, resale of digital files, template extraction, or use of store content requires our written permission.

10. Store content

The Gifted Photo brand, website, product examples, designs, software, text, and other store content are owned by or licensed to us and may not be copied, scraped, reverse engineered, republished, or commercially exploited without permission.

11. Prohibited use

You may not use the store to break the law, infringe rights, impersonate another person, commit fraud, attack or disrupt the service, bypass generation or security limits, scrape content, or upload harmful code.

12. Third-party services

The store depends on third-party services for ecommerce, payments, AI generation, hosting, production, and shipping. Their outages or delays may affect the service. Nothing in this section limits rights that cannot legally be excluded.

13. Disclaimer and limitation of liability

To the maximum extent permitted by law, the service is provided on an "as available" basis. Gifted Photo is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by information supplied incorrectly by the customer.

Nothing in these Terms excludes liability or consumer rights that cannot be excluded under applicable law.

14. Governing law

These Terms are governed by the laws applicable to the legal operator of Gifted Photo, without depriving U.S. customers of mandatory consumer protections available under applicable federal or state law.
